Sample of Business Associate Agreement Physicians Providing Telemedicine Solutions Must Enter

If a physician uses a telemedicine solution that stores electronic personal health information, he/she must enter into a Business Associate Agreement (BAA) with the solution provider. A sample of the agreement is provided below.

This document includes sample business associate agreement provisions to help covered entities and business associates more easily comply with the business associate contract requirements.  The HIPAA Rules generally require that covered entities and business associates enter into contracts with their business associates to ensure that the business associates will appropriately safeguard protected health information.
